LIABILITY WAIVER; LIVE STREAMING, ONLINE CLASSES
Clients participating in or responsible for children participating in online classes with Mrs Samantha Melville-Smith and/or her teachers as ‘Inspire Ballet & Dance London’, either remotely as live-streaming, or as pre-recorded classes, are required to read and sign this agreement and liability waiver as part of enrolment and registration.
Our insurers, Gordon & Co. First Step Insurance have arranged cover for Public Liability, to a maximum indemnity of £5,000,000 for online dance classes, as provided by Samantha Melville-Smith and/or her teachers and instructors. Moreover, such online and streamed classes are presented under the same safeguarding rules in place for all events and classes.
Please read and confirm the following carefully;
1.] Attendees and Participants must adhere to this Health and Safety warning which is issued to all participants joining classes. Attendees and participants must ensure that …
(i) They have enough room to participate in the activity without there being any obvious risk of injury to themselves, to others, or risk of any damage to surrounding property.
(ii) That the flooring in the room is safe for the activity to be undertaken, as much of the participant’ s view is presented on the screen to enable efficient teaching feedback, and appropriate clothing is worn by participants.
(iii) That where appropriate, and especially in respect of activities for children, participants have suitable safeguarding measures in place, a parent/guardian present, or the consent of the parent/guardian for the children/child to participate at home.
2.] Affirm that they have been advised and informed of the inherent risks of exercise, and
3.] In Registering or Enrolling for, and Participating in and/or Attending I understand that the precise mode of teaching will be slightly different to that in an actual physical class, and moreover
4.] That by participating in and/or attending the ONLINE classes, I/they/he/she agree(s) to the assumption of personal risk in so doing; and also that, should the general Health and Safety practical and safeguarding requirements above not be complied with, I/they/he/she relieve both Mrs Samantha Melville-Smith, trading as ‘Inspire Ballet & Dance London’ (The Business) and the business’s officers and employees (the Released Parties) from liability and responsibility for any injury, death or damages that may occur to me or those in my care as a result of participation in or attendance at the course, or as a result of the ordinary negligence of any party associated with the course including the Released Parties whether passive or active.
Live classes where participants opt for ‘video off’ must be supported by prior written consent. ‘Video off’ Live sessions and Pre recorded classes, must agree to adhere to the above health and safety warnings and to the assumption of risks outlined above. Online classes will be recorded by the host for use as evidence and in school training.
Furthermore I agree to waive, relieve, indemnify and hold harmless the course, classes and the Released Parties from any suit, claim or lawsuit by me, anyone purporting to act on my behalf, my family, estate, heirs or assigns arising directly or indirectly out of my Registering or Enrolling for, and Participating in and/or Attending the said course or classes.
I further state that I am of lawful age and legally competent to sign this liability release and waiver, on behalf of myself, or as the parent/guardian of the child/children named above.
This is the entire agreement between Myself and the Released Parties and supersedes all/any prior written or verbal agreement.
